These Terms & Conditions govern the design and development services provided by Appaza (“we”, “us”) to you (“the client”). By paying the advance and starting a project with us, you agree to these terms. The specific scope, price and timeline are set out in your individual proposal, which forms part of this agreement.
1. Our services
We provide design and development services — including Shopify apps and themes, WordPress themes and plugins, custom websites and web applications, and deployment support — as described in your proposal.
2. Payments & project process
Our standard engagement works as follows:
- 25% advance to start. A 25% advance of the project fee is required before any work begins. Your project is scheduled and started only after we receive the advance.
- Demo on completion. Once the agreed scope is built, we share a working demo of your website or app on our staging environment for you to review.
- 100% payment after approval. When you approve the demo, the remaining balance — bringing the total to 100% of the project fee — becomes due.
- Deployment after full payment. We deploy the project to your live server or hosting only after the full payment has cleared.
All prices are quoted in your proposal and are exclusive of third-party costs (see section 7).
3. Scope & revisions
The work is limited to what is described in your proposal. Reasonable revisions within that scope are included. Anything outside the agreed scope — new features, extra pages, redesigns or change requests — will be quoted and billed separately.
4. Timeline
Timelines in your proposal are estimates. They depend on receiving your content, feedback and approvals on time. Delays in feedback or third-party access may move the delivery date.
5. Your responsibilities
- Provide content, assets, brand materials and any accounts or credentials we need.
- Give clear, timely feedback and approvals at each stage.
- Ensure you hold the rights to any material you supply to us.
6. Support, security & updates (1 year free)
Every project includes one (1) year of free support from the deployment date, covering:
- Security updates and patches.
- Plugin, theme and dependency updates to keep the site safe and stable.
- Bug fixes for the features we delivered.
Free support does not include new feature development, design changes, new pages, content updates or third-party costs — these are quoted and charged separately. After the first year, ongoing support is available under a maintenance plan.
7. Third-party costs
Hosting, domain names, paid plugins, themes, APIs, SaaS subscriptions and similar third-party costs are the client’s responsibility and are not included in the project fee unless stated in the proposal.
8. Intellectual property
Ownership of the final deliverables transfers to you once full payment is received. Until then, all work remains our property. We may display the completed work in our portfolio and case studies unless agreed otherwise in writing.
9. Cancellation & refunds
The 25% advance is non-refundable once work has begun, as it reserves our time and covers initial work. If you cancel mid-project, any work completed up to that point is payable.
10. Warranty & liability
We deliver our work with professional care. Beyond the agreed scope and the included support, the work is provided “as is”. To the extent permitted by law, our total liability is limited to the fees paid for the project, and we are not liable for indirect or consequential losses.
11. Confidentiality
Both parties agree to keep each other’s non-public business information confidential.
12. Changes to these terms
We may update these terms from time to time. The current version will always be on this page with a revised date. Your active project is governed by the terms in force when it started, together with your proposal.
